ZCR Bylaw

Name of organization
This organization is named as Chin Refugee Committee (CRC).

Place
Chin Refugee Committee is located in Kuala Lumpur City, Malaysia.

Possession
Any Chin refugee in Malaysia who is registered with the Chin Refugee Committee holding CRC membership card is considered as a member of the CRC.

Aim
v  To assist the Chin asylum-seekers in their approach to the UNHCR protection.
v  To help Chin ethnicity in social affair.

Position
v  This CRC is an independent organization.
v  CRC shall not involve in any political activities, religious affair and any racist movement.

Administration
v  The General Assembly has the supreme authority. The General Assembly is the meeting held by the delegates from respective region committee.  
v  Executive Committee has the second supreme authority.
v  The CRC Office Bearer has the third supreme authority.

Confirmation and Amendment of Constitution
v  Only the CRC General Assembly is authorized to make confirmation, amendment, addition and removal of the constitution.
v  CRC constitution could only be confirmed, amended and added and removed only when the two thirds of delegate members attended the General Assembly.
v  CRC constitution could only be confirmed, amended and added and removed by the approval of two third of delegates who attend the General Assembly.

Ownership of CRC Property
v  The CRC properties either portable or static should be an in-charge of  CRC property by any member who remains with CRC for the last.
v  If a member abandons the CRC, he is not entitled to take or claim any committee’s belongings. 


CRC By-Law (2009)
Chapter - 1
Responsibility

Article 1: The Responsibility of CRC Ethnic Delegate
1.    The CRC delegates should be appointed from each of the Chin sub-ethnicities.
2.    The duty of CRC delegate is the bridge between the CRC and the communities that he represents.
3.    The CRC delegate should have a good relationship with the leaders of villages from his community.
4.    The Ethnic delegate or hill region delegate must attend the general assembly held by the CRC on behalf of his community. They must have the right to talk and present the requirement of his/her ethnic group in the General Assembly.
5.    He must be a communication medium between the CRC and his community people.
6.    He must be the informer of the current situation and the requirement of the respective ethnic to CRC office.

Article 2: The Responsibility of CRC EC
2.1 The CRC EC should call for the general assembly.
2.2 The CRC EC must set up the agendas prior to the general assembly.
2.3 CRC EC must always consider for the progress of the committee.
2.4 CRC EC meeting must be held monthly. The CRC EC can call for the
       emergency meeting, if necessary.
2.5 CRC EC is responsible for projects planning for each year.
2.6 CRC EC is responsible for drawing the budget for the committee.
2.7 CRC EC is responsible for maintenance of the committee’s properties.

Article 3: The Responsibility of the CRC Office Bearer
3.1 CRC OB must implement the decision which has been made by the EC.
3.2 CRC OB must prepare the agendas for the EC meeting in advance.
3.3 CRC OB must monitor the operation of the committee office.
3.4 CRC OB must held meeting if it is required.
3.5 CRC OB must handle the income and expenditure of the committee and  
       must present the audited balance at the EC meeting.
3.6 CRC OB must report the activities of the volunteers to the EC meeting.

Article 4: The Responsibility of the CRC Coordinator
4.1 CRC Coordinator must liaise with the UNHCR, NGOs and committee.
4.2 CRC Coordinator must attend the meeting held between the committee
      and UNHCR, NGO and must report the meeting minutes to the OB and
      EC.
4.3 CRC Coordinator must perform the job only after getting the approval of
      the OB.

Article 5: The Responsibility of the Chairman
5.1 CRC EC Chairman must implement the decision made by EC meeting.
5.2 CRC EC Chairman must act as a chairman at every meeting.
5.3 CRC EC Chairman must be the administrative officer for planning the
      budget and the expenditure.
5.4 CRC EC Chairman must be the person in-charge for the relationship
      between the ethnic groups and CRC.
5.5 CRC EC Chairman must be the representative of the Coordinator.



Article 6: The responsibility of the CRC Vice Chairman
        CRC Vice Chairman must be assistant to the EC Chairman.
        CRC Vice Chairman can be an acting chairman.

Article 7: The Responsibility of the CRC EC Secretary
7.1 CRC EC Secretary must write meeting minutes.
7.2 CRC EC Secretary is the person who calls for the meeting.
7.3 CRC EC Secretary must be a convener of auditors.
7.4 CRC EC Secretary must be the officer in-charge of the office.
7.5 CRC EC Secretary must be a trustee of the committee’s properties.
7.6 CRC EC Secretary must be the officer in-charge of handling daily invoice.
7.7 CRC EC Secretary must trust the monthly balance to the treasurer.

Article 8: The Responsibility of CRC Assistant Secretary
8.1 CRC Assistant Secretary must assist the secretary.
8.2 CRC Assistant Secretary can represent the secretary.

Article 9: The Responsibility of the Treasurer
9.1 The Treasurer is responsible for handling the finance.
9.2 The Treasurer must keep the money in safety box and is not allowed to bring
      home.
9.3 The Treasurer must prepare the monthly financial statement and present at
      the meeting.

Article 10: The responsibility of the Auditor
10.1 The Auditor must audit the CRC finance once in every two months.
10.2 The Auditor must report the financial statement at the CRC EC meeting.

Article 11: The Responsible of the Medical Coordinator
11.1 Medical Coordinator must be responsible for health issue.
11.2 Medical Coordinator must attend the meeting related with health issue and
        health awareness training.
11.3 Medical Coordinator must be responsible for funeral issue.

Chapter – 2
Authority

Article 12: The Authority of the CRC General Assembly
12.1 The CRC General Assembly must have the highest power.
12.2 The CRC General Assembly must elect the Committee EC.
12.3 The CRC General Assembly can demolish the Committee EC.
12.4 The CRC General Assembly can do confirming, editing and canceling
        CRC constitution and by-law.
12.5 In case the CRC EC fail to hold a General Assembly in appropriate time,
        the representatives of General Assembly can call for a General Assembly.

Article 13: The Authority of the CRC EC
13.1 The CRC EC is authorized to call for a General Assembly.
13.2 The CRC EC is authorized to employ and dismiss staff in the committee.
13.3 The CRC EC is authorized to use up RM 5000 in case of emergency.
13.4 The CRC EC is authorized to employ and dismiss the committee coordinator
        and medical coordinator and must get the confirmation (or) agreement at the
        closest General Assembly.
13.5 The CRC EC must have the authority to increase and decrease the number
        of staff according to the necessity.
13.6 The CRC EC must have the authority to set up a plan and edit the budget of
        the committee.
13.7 If there should be a vacant position within the CRC EC, the CRC EC has a
        right to appoint a new EC member from delegates.

Article 14: The Authority of the CRC OB
14.1 CRC OB has the authority to call for the emergency committee meeting.
14.2 CRC OB is authorized to use up RM 2000 in case of emergency.
14.3 CRC OB shall manage and share the job tasks to the volunteers.
 14.4 CRC OB is authorized to make assessment and decision for people
         whether or not to be allowed to stay in the shelter.
14.5 If there is an advisor or observer, CRC OB is authorized to decide whether
        or not to allow him to attend the meeting.
Article 15: The Authority of the CRC Coordinator
15.1 The CRC Coordinator is authorized to use up to RM 1000 in case of
        emergency.
 15.2 The CRC Coordinator is an authorized person to sign the incoming and
        outgoing letters for UNHCR and NGO.
15.3 The CRC Coordinator must have the authority to speak on behalf of the
        committee at the UNHCR and NGO meeting.
15.4 The CRC Coordinator must have the authority to decide emergency matter
        while working with the UNHCR and NGO organization.

Article 16: The Authority of the CRC Chairman
16.1 The CRC Chairman must have the authority to speak on behalf of the CRC
        committee.
16.2 The CRC Chairman must have the authority to process the incoming and
        outgoing letters of the CRC committee office.
16.3 The CRC Chairman is authorized to lead the operation of the committee.

Article 17: The Authority of the CRC Secretary
17.1 The CRC Secretary is appointed as a leader for daily operation of the office.
17.2 The CRC Secretary must have an authority to speak on behalf of the
        committee chairman and committee coordinator when they are absent.

Article 18: The Authority of the CRC Medical Coordinator
18.1 The CRC Medical Coordinator has an authority to decide emergency matter
        in his field.
18.2 The CRC Medical Coordinator is authorized to spend up to RM 500 in
        case of emergency.







Chapter – 3
Meeting

Article 19: General Assembly
19.1 The General Assembly is to be held at least three times per year. It must
        have an authority to call for an emergency meeting if necessary.
19.2 The meeting could be proceeded only when the attendance is more than
        half of its members.
19.3 In case of any uprising urgent matter, the meeting can be proceeded with
         any percentage of attendance and the meeting minute is to be sent to all
         the members of the committee.
19.4 If an emergency general meeting is demanded to be held by either a certain
        member or a delegate or EC member, the meeting can be proceeded only if
        the two third (66%) of its members attend. If it is not proceeded for one time,
        it cannot be called for the second time.
19.5 Any person can attend the meeting as an observer but they do not have a
        right to vote.
19.6 Only when the attendance is two third (66%) of its members, the general
        assembly can proceeds editing, confirmation, removal and amendment
        of the constitution.

Article 20: EC Meeting
20.1 The EC Meeting is to be held once a month and if necessary an emergency
        meeting can be called for.
20.2 Any regular meeting can be proceeded only if the attendance is more than
        half of its members.
20.3 In case of any uprising urgent matter, the meeting can be proceeded with
         any percentage of attendance and the meeting minute is to be sent to all
         the members of the committee.

Article 21: OB Meeting
21.1 The OB Meeting is to be held once in two week and an emergency meeting
        can be held if necessary.
 21.2 Any regular meeting can be proceeded only if the attendance is more than
        half of its members.
21.3 In case of any uprising urgent matter, the meeting can be proceeded with
         any percentage of attendance and the meeting minute is to be sent to all
         the members of the committee.


Chapter – 4
Disciplinary Action

Article 22: Disciplines for Delegates
22.1 The representatives for ethnic and hill regions must attend the General
        Assembly regularly. They must report the requirement of the ethnic and hill
        regions at the general assembly and have a continuous relationship with the
        OB and EC.
22.2 The representatives must not drink any alcohol when they go in and out of
        the committee office and attend the meeting.
22.3 The representatives must not find own fortune using the committee         
        name. They must not involve in any bribery. 

Article 23: Disciplinary Action on Delegate
23.1 According to the law 22.1 mentioned above, any delegate who breaks the law will be reported to ethnic concern and hill region, if it is required, he could be replaced. Those who have breached the regulation acts (22.2), (22.3) and (22.4) will be investigated by the EC and taken an action if necessary. The delegate will be replaced by the elected person from the ethnic concerned and delegate from hill region.

Article 24: Discipline for EC Member
24.1 The EC member must attend the every meeting related with committee.
24.2 The EC members are strictly prohibited to use drugs and alcohol in
        meeting and during the office hours.
24.3 CRC EC members are not allowed to seek his/her own profit by using the
        CRC community name and also prohibited any bribery.
24.4 CRC EC members should be free from sexual exploitation.
Article 25: Disciplinary Action on EC member
25.1 If any EC member absent to attend the meeting for two consecutive times without proper reason, he will be dismissed from his position. And he will be replaced by another delegate according to regulation acts (24.2), (24.3), (24.4).

Article 26: Discipline for OB members
26.1 The CRC OB members must attend the office regularly. If he is to be absent,
        he must inform in advance.
26.2 Using any drug during the office hours is strictly prohibited.
26.3 CRC OB members are not allowed to seek his/her own profit by using the
        CRC community name and also prohibited any bribery.
26.4 CRC OB members should be free from sexual exploitation.

Article 27: Disciplinary Action on OB members
27.1 If the OB members are absent to attend the office without any proper
        reason, they will be given warning by the EC. If the OB members still do not
        follow the rule, they will be dismissed if necessary. If he fail to obey the
        regulation acts (26.1), (26.2), (26.3) and (26.4), he would be replaced by
        another delegate from his community.

Article 28: Discipline for Volunteer Staff
28.1 The CRC staff should not only obey the office rules and regulations but also
        fulfill the duties assigned by the EC.

Article 29:  Disciplinary Action on Staff
29.1 If any office staff does not obey the office rules, the OB has an authority to
         suspend temporarily. And OB also has the authority to terminate him after
         obtaining the agreement from the EC.






Chapter – 5
Election
Article 30: Election Period
30.1 Once in two year, Committee (delegates, EC members, OB members,
        Committee Coordinator, Medical Coordinator) are to be elected.
30.2 CRC calendar is determined a year from January to December.
30.3 The election year for CRC representatives are to be elected in October of
        that year.
30.4 CRC EC and OB are to be elected in November of that year.
30.5 In December of the CRC election year, the new and old ECs are required to
        work together.
30.6 After holding the CRC election, during the first week of January in the next
        early year, the former committee should transfer the responsibilities to the
        new elected committee.

Article 31: Elector
31.1 CRC delegate should send the elected delegates by the people in the
        respective region allocated by the committee.
31.2 CRC EC members are to be elected from the delegates who represent the
        respective communities.
        (Note: If there is a vacant position within the EC before the election period, it
        should be replaced by the delegates of the respective communities and a
        new delegate should be appointed to replace him.
31.3 CRC office staff should be appointed from CRC EC members.
        (Note: If there is a vacancy in the OB, the position can be replaced by only
         EC members)
31.4 CRC Coordinator should be elected by CRC EC.
31.5 CRC Medical Coordinator should be elected by CRC EC.

Article 32: Election Rule
32.1 CRC delegates, CRC EC, CRC OB shall not be a member of any other
        organization.
32.2 CRC delegates should be appointed according to the population of each
        community members from (10) regions such as (9) townships from Chin
        State and Kale-Kabaw-Kankaw valleys.
       (The (9) townships from Chin State are Hakka, ThanTlang, Falam,
       Tedim, Tonzang, Matupi, Mindat, Paletwa and Kanpalet)
32.3 In the election year, the number of delegates should be fixed according to
        the members population from each region. To determine the number of
        delegates, one delegate can be appointed by the member population of 200
        to 500. Additional delegate can be appointed for each additional 500
        members.
32.4 The number of CRC EC members should be halved of the number of
       delegates. And should be focused to include one EC member for
       each of the 10 regions so that no region would be left out.


Chapter – 6
By-Law Confirmation (2009)

The CRC constitution (2009) and By-Law (2009) has been edited and amended based on the situational needs based on the CRC By-Law (2008) according to the CRC EC approval. The draft constitution was prepared and reported to the CRC General Assembly by the CRC constitution proposing committee. The General Assembly of the CRC made the confirmation on the 27th of September, 2009.

(2009) By-Law Acknowledgement

We do not assume that this Constitution and By-Law is completely perfect. In future, it can be edited, amended, added and removed depending on the situational needs.
